Planning Ahead
3 Documents You Need

  • Holly Gunn, Rene Kremisis and Hayley Kelloway in the Wollongong office in Fairy Meadow

    01 | Will

Your Will states who receives your assets, who looks after your estate (your executor) and who you’d like to care for children and even pets.

  • Holly Gunn Wollongong Partner family lawyer and oversight

02 | Enduring Power of Attorney

This document allows someone you trust to handle your money and property if you can’t. For example after an accident or illness you may appoint someone to this role to be an extra layer of support and also security.

  • HCC Lawyers team and client meeting in the Wollongong office in Fairy Meadow

03 | Appointment of Enduring Guardian

This allows someone you appoint and trust to make health, medical and living decisions for you. This only takes effect if you lose the capacity to make decisions for yourself.

UPDATING
YOUR WILL

When to update your Will:

  • You buy or sell a home

  • You marry, separate or divorce (marriage usually cancels an existing Will in NSW, and Divorce can cancel gifts to a former spouse)

  • You have a child or grandchild

  • An executor or beneficiary passes away

  • You start or sell a business

  • It’s been five years since you last looked at your Will

YOUR WILL
CHECKLIST

What to bring to a Wills appointment:

  • The list of your main assets and debts (home, super, bank accounts, shares, vehicles, business interests)

  • Names and contact details for the executor(s) and beneficiaries

  • Any existing Will or Power of Attorney

  • Your wishes for guardians if you have young children

  • Life insurance and super beneficiary nominations
